On this 27 day of June, A.D. one thousand eight hundred and eighty two, personally appeared before me, Clerk of the County Court, a court of record within and for the county and state aforesaid, James Baity, aged 37 years, a redident of the county of Lawrence, state of Ohio, who being duly sworn according to law, declares that he is the identical James Baity who was enrolled on the 21st day of Oct, 1862, in Company K of the 39 regiment of KY Vol Infantry commanded by Capt Nathaniel Collins, and was honorably disharged at Louisville, KY on the 15 day of September, 1865; that his personal description is as follows: Age, 37 years; height 5 feet 8 inches; complexion, fair; hair, dark; eyes, gray. That while a member of the organization aforesaid, in the service and in the line of his duty at Georges Creek, in the state of Kentucky on or about the 1st day of March, 1863, he contracted the disease of Rheumatism caused from exposure to severe and incliment weather.

That he was treated in hospitals as follows; Regimental Hospital for said disease and by asst surgeon Draper

That he has not been employed in the military or naval service otherwise than as stated above

That since leaving the service this applicant has resided in the county of Lawrence in the state of Ohio, and his occupation has been that of a farmer. That prior to his entry into the service above named he was a man of good , sound, physical health, being when enrolled a farmer. That he is now partially disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States.

He hererby appoints, with full power of substitution and revocation, Thomas J. Ewing of Catlettsburg, state of Kentucky, his true and lawful attorney to prosecute his claim. That he has not received nor applied for a pension. That his Post Office Address is Catlettsburg, county of Boyd, state of Kentucky.

Case of James Beaty - No 663,634

On this eighteenth day of June, 1894, at Sybene, County of Lawrence State of Ohio, before me, H C Duncan, a special examiner of the Pension Office, personally appeared James Beaty, claimant, who, being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim aeposes and says;

I am 50 years of age, post office address above stated. Occupation was farming and laborer. I enlisted in South Point - Lawrence Co O, in Co K 39th KY Vol In, in Oct 1862 and was disharged in Sept 1865. I rendered no other military service. I am pensioned under Act of June 27th 1890 and desire to complete my claim under the general law filed in 1882 on Rheumatism which was contracted at George's Creek, KY about March 1st 1863. I also suffer from heart and lung trouble which I believe to be the results of my rheumatism.
At date of my enlistment I resided with my father on a farm about one and one half miles from this P.O. My father had lived here only about one year my father having refuged from Russell Co VA. Allen Boggs, John Rogers, George Winn & Stephen Rogers knew me well before and at date of enlistment. John Rogers is the only man who enlisted from my neighborhood at the same time with me. My father Robert Beaty is dead and my mother was dead at date of my enlistment.
After enlistment I done the ordinary duties of a soldier and suffered fron disability until about March 1 1863 when at George's Creek, KY when I was taken down in my shanty with rheumatism in my right knee, right ankle and right foot. Our Regt went from (I think) Catlettsburg, KY to George's Creek in February 1863. The weather was rainy and some snow and we were without tents or shelter of any kind except shanties we constructed ourselves after going into camp. Aftertaking rheumatism as stated I was treated by Regimental doctors either Ferguson or Sweatnam in any shanty and about two later was taken to the Regimental hospital at that place for some two or three weeks during which time I was treated by the same doctors. Dr Furgeson is dead and Dr Sweatnam resides at Louisa, KY. I never ask either for an affidavit. After leaving hospital and going to the Company I was occasionaly excused from duty for a time. Likely a week after leaving hospital our Regt left George's Creek, I think in April 1863 for Peach Orchard, KY. I went with my Co

Q - When & where were you next treated or excused from duty on account of rheumatism.

A - I was next treated and excused on account of rheumatism at Paintsville, KY in May or June 1863 for about two weeks. I had no more regular treatments and was not again off duty (although I took medicine to keep the rheumatism off) until at Louisville, KY about three weeks before my disharge when I was taken down with chills and fever & rheumatism. Had that same trouble up to and at disharge and for two years after. The rheumatism at that time was in right hip, knee & ankle. The Regt doctors treated me for this trouble in camp up to my discharge and was all the time off duty.

John Rogers, Henry H Cleon knew of my suffering from rheumatism during service and made statement for me. Arthur Obryan, Jobe Young, Goulder Benn & Jim Woods messed with me. Jim Woods was my bunk mate throughout entire service. I believe they would all remember of my sufferings from rheumatism. I know the address of none except James F Wood box 221 Athens, Ohio. After hearing c____ list read. I have no special reason for thinking any would in particular remember my disability in service.

John Swinnell was orderly during my entire service and when I last heard from him lived on John's Creek near Pikeville Pike Co KY - Nathaniel Collins was Capt - Draper Powers 1st Lieut - 2nd Lieut Saml Keels. Can't give address of any if living.

Q - Where did you go. Where have you been and what has been your occupation since your discharge to the present.

A - I returned to the home of my father near my present P.O. where I remained to 1867 where I was married. My father having died in 1866. After marriage I moved about six miles distance on Symmes Creek of this Co and near what is now Rockwood P.O. on the lands of Robert Eaton. Was there and near there for 9 years when in about 1876 I returned to this neighborhood again and have been here ever since. I have generally farmed for a living up to about 1889 when on account of rheumatism in my limbs I had to go to hunting. For the last three years I have not been able to do anything on account of rheumatism, heart and lung problems

Q - When did you first or previous suffer from Heart & Lung disease.

A - I first suffered from heart trouble about two years after discharge upon my recovery from rheumatism & chills and fever and it continued to grow worse ever since. About three years after my discharge I first suffered from pains in my lung which gradually increased. First had a slight cough about 15 years ago which has gradually grown. Have been coughing hard for the last two and a half years and have not sit up a whole day for two years

Q - What treatment have you had for the above disabilities since discharge.

A - Dr Hall, decd, treated me for rheumatism and fever & ague for the first two years. For the last three years I have been treated by Dr Frank Williams of Burlington Oh. Between the treatment of Dr Hall and Williams I used home remedies and patent medicine. Dr Williams was first called five or six years ago and has been my family physician ever since.

Q - Who of your neighbors and fellow workmen knew you best upon your discharge and from discharge to the present.

A - John Rogers, Stephen Rogers, George Winn, Dolphus Hunt, James Wright, James Crawford & Allen Boggs

Q- During the examination of your claim do you desire to be present in person or by atty.

A - I can't be present and do not desire the presence of an atty.

Duncan, a special examiner of the pension office, personally appeared John Rogers, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am 50 years of age, post office address, Manhattan, Lawrence Co O. Occupation, farmer. I first knew claimant in spring of 1862 as a close neighbor. We enlisted in Co K 39 KY Vol In about the same time. Disharged and came home together.

Q - Was claimant in any way disabled in service.

A - Yes, he had rheumatism at mouth of George's Creek in spring of 1863, can't state month. He was sent to Regt hospital and was there for two or three weeks and was treated by Dr Ferguson. I was in that hospital at the same time. Had rheumatism all over him. He returned to the Co from that hospital but had rheumatism at various times after but I can't fix dates and places.

Q - What was claimant's condition at discharge and on the way home.

A - He then had fever & ague and rheumatism. Had been sick a week at least before discharge and for six months after with those diseases. He was sick in camp and treated by, I think, Dr Draper, our surgeon, before discharge. After our discharge for several years we resided near each other. He then moved about five miles distant but we frequently met while living there and later moved near me again and now lives about two & a half miles from me. he has had the rheumatism off & on ever since his discharge and I know of him having spells when he would be laid up.
For the last four or five years he to all appearances has suffered from lung disease and is now bad off
I have no recolection of him suffering from any other disabilities.
I have worked at various times with the claimant since our discharge and we have all along been intimate. He has not been able to do any work for the last four years.

Claimant is a cousin of mine but I have no interest in his case or in it's prosecution.

I understand your questions and my answers are correctly recorded in this deposition.

On this eighteenth day of June 1894, at Howell, County of Lawrence, state of Ohio, before me, H.C. Duncan, a special examiner of the pension office, personally appeared Stephen Rodgers, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am 48 years of age post office address stated above. Occupation, has been farming.

I first knew claimant in Oct 1865 upon my return from the army where I resided about half a mile of him for some fifteen years. After that time he resided some farther although I visited him and of late years he has come back to this neighborhood and now lives about one & one half miles of me.

Soon after the war I worked some with him.

Inside of two months after I became acquainted with him he complained of rheumatism in his arms & legs and was at times lame in walking. I knew of him some years after the war being disabled and laid up from work on account of rheumatism and other times later.

For the last two or three years he has suffered from a cough and it is generally understood he now has comsumption. Have not for the last two years heard anything of rheumatism, his complaint during said time being lung trouble.

I am a brother-in-law of claimant but have no interest in his case or in it's prosecution.

Duncan, a special examiner of the pension office, personally appeared James Wright, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am 65 years of age post office address stated above. Farmer. I have known claimant since childhood. We lived near each other in old VA and claimant & his parents at the date of his enlistment resided on the adjoining farm to me.

Q - Was claimant in any way disabled when he enlisted.

A - He was able bodied at enlistment as far as I know.

Q - When did you first see and know his physical condition upon his discharge and return from service.

A - Claimant's parents at his discharge resided at same place he enlisted from and I saw him just after he got home. He was complaining soon after he came home of chronic diarrhea. Was sick other ways but I don't remember what it was.

Q - Do you know of him later complaining of or suffering from any other disabilities, if so what is it.

A - He has suffered from lung trouble for the last year or so - yes for the last four years. I remember of no other troubles.

Q - Do you know of claimant at any time suffering from fever & ague, heart disease, lung disease and rheumatism, if so when did you first know it.

A - I know of him complaining of all these troubles but can't say when it was. My memory of late is no good.

I am not related or interest.

I have this day recieved voucherfor payment of $194.20 for back pay of pension to James Beaty. Now I will inform you that James Beaty named in the voucher that you have forwarded is dead. He died on the 29th day of September 1894. I am his widow and if it is proper and according to law you please forward to me widow's voucher. I am advised that it is not lawful for me to sign those vouchers.

I herewith return those vouchers you have sent and if is right that I should sign them please return them to me with instructions what to do.

On this 27th day of May A.D., one thousand eight hundred and ninety five personally appeared before me a Justice of the Peace within and for the county and state aforesaid Matilda Beaty aged 42 years, who being duly sworn according to law, makes the following declaration in order to obtain the pension provided by acts of Congressgranting pensions to widows: That she is the widow of James Beaty who enlisted under the name of James Beaty at George's Creek, KY on the 24th day of October A.D., 1862 in CoK 39 KY Inf in the war of 1861 who died of rheumatism and heart trouble at Sybene, Lawrence Co, Ohio on the 29 day of Sept A.D. 1894, that she was married under the name of Matilda Shafer to said James Beaty on the 5 day of October 1866 by Richard Scott at Boyd Co KY there being no legal barrier to such marriage; that neither she nor her husband had been previously married . That she has to the present date remained his widow; that the following are the names and dates of births of all his legitimate children yet surviving who were under sixteen years of age at the father's death to wit:

That she has not abandoned the support of any of his children, but that they are still under her care and maintenance. That she has heretofore received a cert no 410334 Act June 27 1890. On this 20 day of July 1898, at Wolf Pen Hollow, County of Greenup, state of KY, before me, J.A. Salmon, a special examiner of the pension office, personally appeared Matilda Beatty, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am about 45 years old, occupation housewife. P.O. Danleyton KY.
I am the widow of James Beatty who served in Co K 39 KY Vol Inf during the late war. Am now pensioned under the act of June 27 1890 at $8 per month and am now claiming pension under the general law. I was not acquainted with my husband before the war. Became acquainted with him after he was discharged from the service and married him in 1866. Neither he nor I had ever been married before. I was only about 13 years of age when we were married. We lived together as man and wife until my husband's death and were never divorced or seperated. When I married my husband he was complaining of rheumatism and he continued to do so and to doctor for same and for pain in his side up until his death. My husband died Sept 29 1894 near Burlington, Ohio. He died of lung trouble and rheumatism. His limbs were swelled with rheumatism especially his right leg which had purple streaks in it. He spit up great quantities of blood and corruption and had a terrible hacking cough until towards last when he got too weak to cough and just choked. Any of my neighbors around Burlington Ohio can tell you that I just kept him alive during the last year of his life by giving him cod liver oil and drugs. Dr Ben Davis of Huntington W VA, a druggist, furnished him almost of his medicines. We kept him almost on cod liver oil and wine. Dr Davis told me and told my husband that he believed that his rheumatism had gone to his lungs. It was about four years before he died that I first noticed and heard him complaining of a hacking cough. This was the first sympton that I ever noticed of his disease of lungs although he had always been complaining of rheumatism. For three years before he died he could not work at all and during the last year of his life he spit up blood and corruption freguently having numerous hemorrhages. Dr Frank Williams of Burlington Ohio was his attending physician during his last sickness but was not present when he died. Dr Williams told me that my husband had consumption and that he could do nothing for him. No my husband did not complain of his lungs when I married him. He had chills and fever when he came out of the army and complained of rheumatism but the rheumatism did not go to his lungs until about four years before his death. During his last sickness he night sweats so severly that I most every morning we would have to change the sheets and bed clothes because they were so wet.

Dr Hall & Dr Ricketts, both dead, were my husbands first physicians after his discharge. Dr F.H. Williams of Burlington Ohio and Dr Ben Davis, druggist of Huntington, W VA are the only living physicians who treated my husband.

I have not remarried since my husband's death. Any of the above named witneses can testify to that. I have not lived with any man as his wife. My two boys Robert and Williams live with me. Robert will soon be 19 and William is 16.

A family by the name of Mooney moved here from Burlington Ohio before I did. They are the only ones from that section. I have hired James Mooney to help my boys make nails but he lives with his brother, Tom Mooney's family. He has stayed at my house nights occasionaly but he and my boys sleep together. He is helping biuld fence about my place. My sons Robert and William are the only children I had living at time of my husband's death who were under 16 years of age and they are now living here with me. Robert was born October 17 1879 and is now over 16 years of age. William Beatty was born July 9 1882 and is now 16 years of age. Both have always been under my care and custody.

No I do not remember my husband complaining of his lungs or showing any evidence of lung disease until about four years before his death, after the rheumatism had gone to his lungs. I never heard him say that he had contracted disease of lungs in the service from cold and exposure. Rheumatism and chills and fever are the only disabilities I heard him say he had while in service. I have understood your questions and am correctly recorded.

On this thirteenth day of September 1898, at Howell, County of Lawrence, state of Ohio, before me, H.C. Duncan, a special examiner of the pension office, personally appeared Stephen Rodgers, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am about 52 years of age; my post office address is Howell, Lawrence Co, Ohio, Occupation - Barber & shoe mender.

I am acquainted with claimant and was acquainted with her husband James Beatty from about November 1865 to his death and during my acquaintance with said soldier I lived near as a neighbor and visited him during his last illness. Said James Beatty, as I understand and believe, died of consumption. I was not present when he died but saw him a few days only previous.

For some two or three yrs before his death I think he suffered from disease of lungs which I believe was the results of exposure while peddling produce. Previous to this his only disability, as far as I know, was rheumatism. This lung trouble commenced with a cough and wheezing the results of a cold. I was at his house when he came home complaining and was then on his way to Ironton with marketing. That was about 3 yrs before his death and he from there from time to time growed worse to his death from consumption. Dr Williams, his last physician, told me that disease was the cause of his death. Never heard or knew of any lung disease or symptoms of lung disease previous to the time stated.

I remember making an affidavit for soldier in relation his rheumatism. The signature you show me is genuine and the affidavit is correct. I am a brother-in-law of claimant but have no interest in this case. My statement is correctly recorded in this deposition.

On this fourteenth day of September 1898, at Howell, County of Lawrence, state of Ohio, before me, H.C. Duncan, a special examiner of the pension office, personally appeared John Rogers, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am about 55 years of age; my post office address is Howell, Lawrence Co, Ohio, Occupation - Farmer.

I am acquainted with claimant and I knew her husband James Beatty from the time he came to this county from VA in I think 1862. We enlisted near the same time and served together in Co K 39 Ky Vol In from Oct 62 to Sept 65. During our service we messed & bunked together. Upon our discharge we returned to same immediate neighborhood and resided near each other to his death from consumption. Soldier at enlistment was able bodied as I believe and for some time there after. He was first disabled at George's Creek, KY in early spring of 1863 by rheumatism and suffered more or less from rheumatism during service and after service to his death. That was his only disability during service except chills & fever. We all had about the time of our discharge and for some time later.

The first I knew of him having lung disease or any symptoms of lung disease was some three yrs before his death, when he commenced to cough and soon after to spit up and he all along growed worse to his death and during last immediate illness he expectorated freely a matted offensive stuff.

As far as I know rheumatism was soldiers only disability after his service to some three yrs before he died when he was said & generally understood to have consumption. I was frequently with him each year after his service, worked some with him, visited him at various times during his last illness and attended his funeral. Dr Frank Williams was his last physician. It was always my understanding that soldier's lung trouble was the results of exposure through which he went above, 3 yrs before his death. The particulars of which I do not now remember although I do remember soldier and myself talked of it.

I made several affidavits in this case the signatures to which are genuine after hearing them read. I desire to say I have told you all I know of claimant's husbands disabilies. My brother Stephen married a sister of clmt & I am a second cousin of hers. I have no interest in this case or in it's prosecution . My statement is correctly recorded in this deposition.

On this tenth day of July 1905, at Columbus, County of Franklin, state of Ohio, before me, Fred L Cowles, a special examiner of the pension office, personally appeared Matilda Beaty, who being by me first duly sworn to answer truly all interrogatories propounded to her during this special examination of aforesaid pension claim, deposes and says; I am about 52 years of age; my post office address is Ohio Penitentiary Columbus Franklin Co Ohio.

I am the widow of James Beaty who served in Co K 39th Ky Vol Inf during the war of the rebellion

I am a pensioner under the new law, my claim under the old law was rejected

I was married to the soldier at Cattletsburg Boyd Co Ky on the 4th day of October 1866 by Richard Scott a justice of the peace. Neither the soldier nor myself had been previously married, we were not divorced and I have not remarried since his death.

Q - Have you lived with any man as his wife since the soldier's death.

Ans - I have not, I have had no intercourse with any man whatever since James Beaty's death.

Q - Please state what you were committed to this institution for.

A - I was convicted and sentenced to the Ohio State Penitentiary for one year for the crime of inticing into a house of prostitution a girl under the age of 18 years. I had a jury trial. I was sent from Sybene Lawrence Co Ohio. The trial took place at Ironton Oh the county seat.

Q - Whose house was it that you were supposed to have enticed this girl.

A - To my daughter's at Lexington KY. My daughter's name is Bell Burnett; she is still living in Lexington, Ky.

Q - What was the girl's name

A - Ethel Hicks, she was living in Sybene then.

Q - How long had you Lived in Sybene?

A - Sybene had been my old home and I always lived there except when I was away living with the boys. I had been back in Sybene two or three years when this happened. Q - Who lived with you in Sybene?

A - My brother Nathan and my son Robert Beaty, they are both still there.

Q - Besides them who lived in your house.

A - A Dr Williams, who had a store there boarded with me but roomed at his store.

Q - And you deny under oath, do you, that you have ever lived in adulterous cohabitation with any man since that soldier's death.

A - I do

Q - By whom can you prove your good character.

A - By the preacher Elder Ball, a close neighbor, Mr Rockwell, my next door neighbor, Mr and Mrs Howe, their place adjoins mine, anyone in the neighborhood - I don't care who they go to.

Q - Who appears against you.

A - Alex Howe, Mr Pritchett, the justice of the peace and the girl's father & mother, Charley Hicks and wife. I was never in my daughter's house after she moved to Lexington. I don't know whether she runs a house of ill fame or not.

The special examiner has explained my rights and priviliges to me. Of course I cannot attend any further examination of my claim in person but I would like my son Robert Beaty at Sybene. I notified when testimony is to be taken at that point.

I deny most emphatically that I have ever lived in adultery or that I have done anything to dishonor the soldier's memory. I never lived with James Mooney or any other man but my husband. Mooney is dead long ago, his brother Low Mooney lives in central City W VA across the river from Rockwood.

On this twenty fourth day of August 1905, at Sybene, County of Lawrence, state of Ohio, before me, Wm Hughes, a special examiner of the pension office, personally appeared Robert Beaty, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am in my 26th year and my post office address as given above.

Pensioner is my mother and I lived in the same house with her until she was sent to state prison about April 1905.

While she was living at home here my uncle, Nathaniel Shaffer and I lived in the same house with her. Part of the time a girl named Myrtle Smith lived in the house with us also but she left about six months before my mother got into trouble and is now married and lives a short distance from here with her husband Robert Smith. Her name before she was married was Myrtle Adams. No other person lived in the house of my mother during the three years or so that she lived here before she got into trouble but Dr H.A. Williams, who kept store here then, boarded at the house with my mother. There were two bedrooms in the house at the time. In the front room there was but one bed and Dr Williams slept on it part of the time and before he had his storeroom fitted up with a cot. After he had the cot placed in his storeroom he did not sleep in the house of my mother any more "not that I knowed of". In the back room there were two beds and my uncle and I slept in one of them and my mother slept by herself in the other one but when Myrtle Adams was with us she slept with my mother.

Ques - there were not two beds in the front room and only one bed in the back room.

Ans - No sir, there were two in the backroom and only one in the front room.

Ques - I have now read to you the depositions - Alonzo Boggs, Wilson Boggs, Cornelius J Rogers and Wilson Pritchard, taken on yesterday when you were absent from home. Two of these witnesses testify that there were two beds in the front room of your mother's house and but one bed in the back room. Do you wish to confront the witnesses who have testified as stated?

Ans - I do, they are mistaken.

On this twenty fourth day of August 1905, at Sybene, County of Lawrence, state of Ohio, before me, Wm Hughes, a special examiner of the pension office, personally appeared Robert Beaty, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

SUPPLEMENTAL
I am pensioner's son and have been present on her behalf during the examination of his claim on their date.

The testimony taken on yesterday has also been read over to me and I was present, when you the examiner, again called on the witnesses, Cornelius J Rogers and ALonzo Boggs and questioned them as to the correctness of their statements and know that both adhered to what they had testified to on yesterday, with this exception.
Alonzo Boggs admitted today that when he called to get some tablets from Dr Williams at the house of my mother one night after midnight once and was waited on by my mother, that he could not tell whether when she admitted him to the house. She may not have come in her night clothes from the back room on that night. He did not know in which room or on which bed she had been asleep on that night.

This statement has been read to me and is correct as recorded and I have no more testimony to offer.

On this twenty fourth day of August 1905, at Sybene, County of Lawrence, state of Ohio, before me, Wm Hughes, a special examiner of the pension office, personally appeared Evelyn Sturgeon, who being by me first duly sworn to answer truly all interrogatories propounded to her during this special examination of aforesaid pension claim, deposes and says;

I am about 47 years of age and my P O address is Sybene Lawrence Co Ohio.

I am the mother of Cornelius J Rogers who has testified in this claim and the deceased soldier James Beaty was my half brother. I have known pensioner ever since she and I were children and was living here while she lived here after the death of my half brother, the soldier James Beaty.

I was in her home several times when he was sick and when Dr Williams was keeping store at Sybene and boarding at the house of the pensioner.

There were two beds in the front room of her house at that time and there was a dresser with a glass on it between them and I saw Dr Williams sitting there in the same room in which pensioner was sick in her bed. It was always in the day time while I was there and Dr Williams was boarding there at the time but I do not know where he slept, Pensioner's son, Robert Beaty, my half nephew is here present now and tells me that he can not remember that there were two beds in the front room when Dr Williams was boarding there but I know that I am not mistaken.

Case of Matilda Beaty - cert No 410,334

On this twenty third day of August 1905, at Sybene, County of Lawrence, state of Ohio, before me, Wm Hughes, a special examiner of the pension office, personally appeared Wilson Pritchard, who being by me first duly sworn to answer truly all interrogatories propounded to him during this special examination of aforesaid pension claim, deposes and says;

I am 38 years of age and _____ _ Sybene Lawrence Co Ohio.

I am a Justice of the Peace and have lived at Sybene for about five (?) years. I knew the deceased soldier, James Beaty, and had personal knowledge of the claimant while she was living at Sybene Ohio during the last three years or so.

I also knew a girl named Ethel Hicks who brought the pensioner Matilda Beaty before me as a Justice of the Peace on the charge of enticing her, Etehl Hicks, to enter a house of prostitution. She, Ethel Hicks, being at the time under 18 years of age. On this charge I turned the pensioner over to the Court of Common Pleas on November 21st 1904 and she was afterward tried before said Court of Common Pleas for Lawrence Co Ohio, and convicted and sent to the state prison where she is at the present time.

I was subpoenaed as a witness in the case before the Court of Common Pleas but was not called to the stand.

While pensioner was living here at Sybene a man named H.A. Williams kept a store about 100 yards or so before the Post Office here and boarded with the pensioner for about one year.

He was also charged before me by Ethel Hicks with having enticed her to enter a house of prostitution, at the same time that pensioner was brought before me on trial charge, but he Williams, waived examinations and I bound him over to the Court of Common Pleas but when pensioner was convicted he "skipped his bond" and I have been asking of him since. The common belief of their community that time when H.A. Williams was boarding at the house of the pensioner was that pensioner was living in adultry with Williams.

A brother of pensioner, Nathan Shaffer and her son, Robert Beaty, made their home with pensioner at the same time that Williams was boarding with her and I have no means of knowing whether pensioner was living in adultry with Williams or not and do not know whether or not he slept in her ____ or not but I do know that his store was often closed up at night when people called on business and he was not there and it was common belief that he was at the house of pensioner, almost 100 years distant from his store and that he slept at the house of pensioner. Williams was a married man and had a wife and family living about Ashland, KY as I understand at the time and I think they still live there.

Pesnioner always bore a bad name for morality while she lived here but she did not keep a house of ill fame although she was talked about as a woman of loose morals.

Portsmouth, Ohio - August 26, 1905
Wm V Warner - Commissioner of Pensions - Washington, D.C.

Sir: I have the honor to return here with the papers in claim Ctf No 410334 of Matilda Beaty, widow of James Beaty, late of Co K 39th Ky Inf Vols, whose P.O. address is, State Prison, Columbus, Franklin Co, Ohio. They were refined for special examination to determine whether the pensioner has remarried or otherwise forfeited title since the soldier's death. Pensioner desired that her son, Robert Beaty, be notified of this parties examinations of her claim. Robert Beaty was absent from home and at work on the day that I began the investigation of this claim but the testimony taken in his absence and before I saw him, was all read over to him. He desired to confront two of the witneses who have testified to the effect that there were two beds in front room of the house of pensioner, his mother, while she lived at Sybene, Ohio; and had a certain Dr Williams boarding with her.

This opportunity was afforded the pensioner's son but in as much as the witnesses adhered in substance to what they had certified in his absence, and he so acknowledges in his supplemental statement herewith. I did not deem it necessary to retake this testimony.

Pensioner is said to have colored blood in her veins and Mrs Sturgeon, half sister of soldier, whose deposition is herewith, is colored. Pensioner always mixed and associated with the colored race while she lived in Ohio; and Sybene, Ohio, where she lived, is a colored settlement and only about three families of the white race reside there now.

There is no "Elder" or "Preacher Ball" residing at Sybene as insticated in initial report but there is a colored preacher named "Boggs" who is evidently the person meant and his deposition herewith.

When pensioner was indicted in November, 1904, a certain Dr H.A. Williams, who boarded at her house, was who indicted on the same charge, viz; That of enticing a girl under 18 years of age to enter a house of prostitution and his name figures prominently in the report. The girl was named Ethel Hicks.

This Dr Williams was examined as a witness when pensioner was tried before the Court of Common Pleas of Lawrence Co, Ohio; and while he himself was made bond, but when pensioner was convicted he left the state and his bond (of $300) was forfeited.

I examined a copy of the record of evidence presented when pensioner was tried but none of it bears directly on her own personal conduct and inasmuch as a certified copy of it would have cost more than eighteen ($18) dollars, I did not obtain a copy.

Dr H.A. Williams was a practicing physician at Ashland, KY when he became acquainted with the pensioner. He had a comfortable home and a wife and family residing in "Pollard", a suburb of Ashland, and he abandoned his practice, this practice as a physician, his home, and his wife and family of Ashland, KY; and moved into Ohio and opened up a little country store at Sybene where pensioner resided then, and went to board at her home. He had a cot placed in his store but it is known that he slept at the home of the pensioner most of the time, and there was talk amongst their white neighbors about the time that he and the pensioner were indicted on the charge of enticing a girl under 18 years of age to enter a house of prostitution, of having them both arrested for living together in adultery.

Two sons of this Dr Williams, one a physician and the other a dentist, reside in Paintsville, Johnson Co, KY; and Mrs Williams, their mother, is there on a visit to her sons at the present times. I saw another son and married daughter at Ashland, KY; and the deposition of the former is herewith. The children keenly feel the disgrace that has been brought upon the family through the association of the husband and father with the pensioner and no one, on visiting his former home and meeting with members of his family fail to wonder how a man of intelligence and having such respectable and comfortable surroundings as he had, could sink so low as he did when he abandoned them to cater to and associate with the pensioner and her colored associates of Sybene, Ohio.

I could not locate the girl, Ethel Hicks, while at Sybene. After much enquiry I located her father of Ironton, Ohio, and learned that she was at the home of her grandmother, a Mrs Pemberton, near Rockwood, Ohio, but I did not then deem it necessary to make another trip there to see her. Nathaniel Shaffer, the pensioner's brother, has no stated home and I did not see him and he would not be a credible witness if seen.

DECLARATION FOR WIDOW'S PENSION - Sep 8 1916

State of Ohio, County of Lawrence

On this 16th day of September, A.D. one thousand nine hundred and sixteen, personally appeared before me, a Justice of the Peace, within and for the County and State afresaid, Matilda Beaty, aged 63 years, a resident of Sybene, County of Lawrence, state of Ohio, who being duly sworn according to law, makes the following declaration in order to obtain pension under the provisions of the Act of Congress approved Sep 8 1916.
That she is the widow of James Beaty, who was enrolled under the name of James Beaty, at Peach Orchard, KY on the 20th day of October 1862, as a private in Co K 39 KY, private, and honorably discharged Sept 15th 1865, having served ninety days or more during the late civil war.

That she was married under the name of Matilda Shafer to said soldier at Boyd Co KY, on the fourth day of Oct 1866 by Squire Scott. That there was no legal barrier to the marriage; that she had not been previously married; that the soldier had not been previously married and that neither she nor said soldier married otherwise than as above stated.

That the said soldier died Sep 29 1894 at Sybene, Lawrence Co, Ohio, that she was not divorced from him, and that she was not remarried since his death.

That the said soldier left the following named children who are now living and under sixteen years of age, to wit; NONE

That she has (she) heretofore applied for pension - YES, James Beaty

That she hereby appoints M. Elliott Waggaman of Washington, D.C., her true and lawful attorney, to prosecute her claim.

That her postoffice address is North Kenova, County of Lawrence, State of Ohio
